What You Need to Know (The Story)

Small Claims Court Limit (€2,000)

Ireland's Small Claims Court handles claims up to €2,000. Over that? District Court. The Small Claims Court is informal and designed for self-representation. Grand for small disputes.

Statute of Limitations

Usually 6 years for contract claims, 2 years for personal injuries. The clock starts when you discovered (or should have discovered) the issue. Don't delay filing.

Consumer Rights (Sale of Goods Act)

Irish consumer law is strong. Sale of Goods and Supply of Services Act 1980 gives you rights if goods are faulty or services are substandard. Use it.

Pre-Action Letter Required

Courts expect you to try resolving disputes before litigation. A demand letter shows good faith. Skip it and the judge won't be impressed.

Success Stories (Your Results May Vary)

"Landlord owed me €1,500 deposit. Sent the letter, had my money back in 10 days. Sometimes you just need to be official about it."

Dublin

Result: Full deposit returned

"Bought a car that was a lemon. Letter referenced the Sale of Goods Act and the dealer refunded me. Know your rights."

Cork

Result: Full refund obtained

Common Questions

Do I need a solicitor?

For Small Claims Court (under €2,000), you don't need one and can't use one at the hearing. For District Court claims, you can represent yourself but might want legal advice for complex matters.

What if they just ignore my letter?

File with the Small Claims Court or District Court. The letter shows you tried to resolve it, which courts appreciate. But it's not magic - some eejits still won't pay until forced.

Can I claim under consumer law?

If you bought goods that are faulty, not of merchantable quality, or don't match description, the Sale of Goods Act probably applies. Same for dodgy services. Strong protections.

How long should I give them to respond?

14-30 days is standard. Give them reasonable time but don't wait forever. If no response, proceed with your claim.
